How difficult will it be to travel on AP? Also if someone has a valid H1B stamp on the passport , can he/she re-enter USA on the same H1-B visa or need to re-enter on AP only in a situaion when I-485 is pending? If the primary applicant is re entering using the valid H1-B, can his/her spouse and children can re enter using the AP? Anyone sharing their experience will be highly appreciated. Also what is the recommended advise for traveling to Nepal? Carry both AP and valid H1-B visa or only stamped H1-B visa should work without having any negative impact on the existing GC (I-485) processing?

Do not travel in AP if you have valid H1-b. There is no problem at all to re-enter US with AP, but you will get 1 year visa when you use AP to stay in US legally. So, until you have valid H1-b, you can use that one anytime to re-enter US, and my suggestion is not to use AP. I had exactly same case, I had both valid H-1b and AP , but i didnt use my AP just because my atorney told me not to use it until i have h-1b. goodluck.

Thanks immensed for your prompt feedback. By the way when was th last time you re entered using your valid H1-B after having your approved AP also. What did they ask you at POE?Also I have one more question.
My spousee doesnot have a valid H4 visa in passport although has an approved extension of H4 until 2009. Will it be advisable to apply AP in that case although the pln is to go and apply for H4 visa in Nepal based upon the approved H4 extension but to have the AP will probably put in safe side just incase the H4 got denied. Any thought on this? Also if the primary applicant re enters on H1-B and th spouse use AP to re enter, does this cause any negaive impact on greencard processing/aproval of pending I-485 for myself and family? What wil be the staus of spouse in this case?Thanks in advance .

Hello Manas,
I am not sure about entering in H1B, but you will be or your spouse and kids will be confronted with a lot of questions if you use the AP to enter the US. So, don't use it and travel if you really do not have to. I have heard from many people that they are asked different things from the begining while travelling on AP. If you are travelling using AP, be sure to carry all the pay stubs and all the documents from the begining and also have every thing regarding your immigration status worked in your mind so that you can answer every question directed at you.

Manas, I just travelled with my H1-b even after receiving AP approval letter without any hassels. Since im unmarried, i really dont have any knowledge about H4 visa and their travel documents. I am sorry but i dont wanna give you misinfo.
