Dear Sajha Experts,

Can a student go to Mexico or Canadaina U.S. Embassy for Visa Renewal who has maintained his/her status during his/her stay in U.S. till now? If you have very good idea regarding this matter, could you please post the details in this thread. Please !

Renewal of Visa (or more correctly your status) is done within the US to the best of my knowledge. You do not have to go out of the states unless you inisist. In case you get new document validating an adjutment of your status (whatever type it may be) then your status is current. Only in case you go out of the country, then you will need restamping of your passport.
So technically once you are in the States, your visa is just a legal piece of paper with your photo id in it, and the little paper I-94 you get t the entry point is all that matter. The I-94 does not bear your photo ID, but actually now indicates how long you can stay in the US without violating the US immigration laws. It follows that the Visa i actually mainly for entry into the US territories.

The temporary visa on my passport and the passport itsself had expired in my case, but before the I-94 cutoff date elapsed, I got my status renewed without my passport restamped, went home to Nepal, got my new passport restamped and came back to the US without a problem. No question asked!

I hope my $0.02 helps, but do talk to your lawyer or friends! I do not see why you cannot visit Mexico and get your passport restamped there, if you insists this way.

Just to avoid confusion I had renewed my passport in Washington DC.

other than your expiring visa you'll need some other supporting documents probably... yours is an F1 type i'm guessing, mine was an H1 type. so there might be a difference in procedure

Many thanks to you for your kind information. I have also renewed my passport from D.C. like you did. I have heard about people going in Mexico and stamp the VISA thing. I wasn't informed how did they do that? But, your response gave me some positive feedback. If you happen to know and gather more information please let me know. As you have mentioned to talk with frineds,i am doing so. Let me see, what they have to say in this matter. Wish me good luck, sir. Again, thank you kindly.

To renew visa(F1), go to El-Paso(Mexico near TX) or Canada. But, it was easy before 9-11. Now, they changed rules. If you don't get visa there, you have to go back Nepal from there. You can not reenter U.S. from there. So, make sure everything(documents) before go there.
If you don't apply for visa, then you can go there (either Canada or MX) for 30 days and can reenter U.S. only showing your I-94 and I-20(Valid) on the boarder.
And be careful across the U.S. boarder!

legal help's link is simply amazing! I've come to know more about F1 situations.
But do you really need to go out of the country? Can you not stick around with an approval of some extension until you decide to go to Nepal (or some other country) out of some really exciting necessity rather than for restamping your (new) passport? Will you share your actual situations in more details?

Unless you are thinking of enjoying salsa there in Mexico as a primary objective of your visit there... As long as every thing goes well, so much the better. If these border guards or the consul there turn out to be nasty to you, you will be forced to enjoy a long flight to Nepal at your own cost, which is pretty expensive.

For F1 renewal you have to go to Nepal and give interview in person, I dont know about H1. Going to mexico and other country and drop box option in Kathmandu all have changed after 9-11.

Some people was choosen that path and got visa in past. Let's see. I will talk with ANTARASTRIYA VIDHARTHI SALAHAKAR ( international student advisor) as well, and see what she has to tell about it.

TD sir, I have a F1 status and doing masters in Civil Eng. & gradutaing in Spring. That is why I wanted to go to Nepal this summer before I graduate. "Tehi ta honi, ghar-ma pani, dherai bhayo bhet ghat bhayena, aaeja bhannu hunchha". "yaha-lai abagat bhayekai kura ta honi" . well !!

I think your status is well maintained, so to say. You'll get the visa you need and deserve. Good that you are shooting at two birds with one stone.
It is still mind-boggling for me to hear that to renew your status you need to get out of the country... and it is the US of A. This is a major joke I have ever heard against the USA's laws. Such an advanced country could have such an oversight!
