Dear all, I need suggestions.
My sister had applied for F1 and her visa got rejected because I have a green card and the counselor told her she is Potential Immigrant. She otherwise has excellent grades, no problem financially and worst is she is the only one amongst her fren who dint get visa, i feel I m responsible for this. Now my question is should she reapply again or wud it be a waste and in the form if she doesnt mention about me being here, will she be caught. Has any body been in similar situation, I just learnt many people dont mention bout their sibling's status. I wud appreciate ur comment.

Since she has already shown you as her sibling she will definately get caught if she makes any changes next time coz every thing is in their record. But there is no harm trying again luck might favour her this time .

As long as you are here legally and on status and with her good grades it should NOT matter....but its hard to say how they make their decission at US embassy in nepal.....

I guess trying for second time is not a bad idea. Your sister should not change anything in her document and should speak truth about you. Since they are claming her that she can be a potential Immigrant, i think your sister should prepare some document which will make them clear that she will return bk to nepal, once her study gets complete eg: if she has any work expe and job gurantee letter after her return might help her.Or some family tie which shows them that she will return bk.Just make sure that she went through all those document which they have mentioned in their list,other than that if they asked for anything else while interviewing, she should be smart enough to reply them that those are the only document that is mentioned in their list. Tell her to be polite, soft, never argue with them. It is all abt luck.. there are so many people who gets rejected at first. So i think she will be alright. Gud luck.

Dear Sadvi, I'm really sorry to hear about your sister's situation. I guess that's just life and things happens. In my opinion there are three ways to approach this issue. a. If your sister had never mentioned you while applying for a visa(which cant be done now of course) they would by no means be able to figure out that you are in the US. If she didn't had put your name down in terms of any brothers or sisters and got some documents such as "relation certificate" from Wada stating that she is the only child then case would have been simpler. She should have been fine. But now if you change thing in your application again she would get busted. b.The people in the embassy need strong ties to your home country. Nothing creates more ties then an intimate relationship. Show that you sister is engaged with someone(unknown) Thats good enough for them. Then thats a more stronger ties then anything else beside marriage of course. But just make sure her fiance is educated and has a decent job etc. (looking at the situation this is the best option) c. Another thing you can do is yes re-apply like people mentioned above. Don't change anything in your documents. Demonstrate your strong ties to the nation for example get a job offer confirming letter with a good pay by a employer upon graduation (i don't know what's your sister's major???) or have several properties under your name listed. Explain them that you have never been anywhere away from home and have always been with your parents and would do anything to make them happy etc.... Tell them that i made a harsh decision and i would be leaving my parents but you did that in order to gain quality education which is not in your country, and since your parents are paying for it you would like to come back and take the job that you have been offered and help your parents. etc etc etc (the bottom line is your sister needs to run her mouth) if she act all innocent and says "yes" or "no" then don't even bother to apply again. I have seen the same case happen to some of my friends here. In your sister's case, like people have suggested above she needs to mainly convince the consular that she would return back to Nepal after she's done with her studies. It is up to you and her what to think of and say to consular to make him/her believe that. Some examples might be your parents are alone in Nepal and you having the green card would not return to Nepal to take care of them, it has to be your suster after she finishes her studies; her engagement; some property in her name etc, anything that might show the chance of your sister going back to Nepal after her studies; job offer might not be a very good idea because think-it is hard for companies to offer job to someone who would finish education and return after 5-6 years, companies will find many within such a period of time.
Choosing major-at least for now-that matches her +2 major or stating major studies as something that does not have a very good scope here in the US and is mainly utilized in countries like Nepal, for example sociology or rural development or something like this.
Another main thing is I have seen several people say that upon being denied a visa, if they politely but firmly ask the consular the reason for their denial, and again try to convince him/her that they (applicant) would return back after the education or visit is completed, they have been given visas. But the applicant should be firm or even politely argue with the consular to prove his/her point.

Tough luck, She shouldn't have mentioned your status. Now they know that you are here w/green card there is no way your sister will EVER get F1 or tourist visa. They have everything on file so she can't deny you being here. If she does deny the fact, she might get permanent ban. But again, getting F1 visa is a case of luck. IF she reapplies, the officer might overlook the fact that her sister has GC and grant her the visa but it would be going against the rule and the officer can get in trouble for doing that.
Better try UK or australia!

US visa seems to depend on pure luck. I think they give visa as a random selection.Many get visa by showing their brothers or sister, or uncle (who are here with green card) sponsoring them from US . But in the mean while some don't get the visa. One of friend was rejected for Fall 2007 as his sponsor was his brother who was in US army. American embassy shows a fuc*ing visa selection procedure. Je bhaye ni tapainko sister lai america ko pelan bhogna bata american embassy le banchit garayo jasto cha................................

Baghbharib The name "Khaobaadi" itself would tell something about myself and my "UCHAA BICHAR" ...Doesnt it..? U_Day May be they(DV PIDITs) should show a great interest (doesnt matter if it's a fake or not) in going to Iraq (after joining US Army)...as we all know they (Army and Marine recuriters) are not meeting the numbers due to the colossal stresses put on the armed forces because of missions in Iraq and Afganistan....Among some Pentagon generals there was even a talk about the Marines pulling out of Iraq alltogether and transferring to Afganistan since the Marines are trained and therefore suited to operate in mountainous regions. Leaving the mission in Iraq to the Army and it's airsupport elements. It's a perfect time to join the Army...the age limit has been relaxed as well. May be "DV PIDITS" should have a new slogan "LET US COME TO AMERICA...WE'll JOIN THE ARMY...AND...GO TO IRAQ"

i read some one said..the major that has a great scope in nepal would really help a lot to persuade ties to nepal and of course the girl needs to be fluent in english and be able to speak with confidence... i sucked at my interview but there was no way my visa could be rejected so it all ended welll...best of luck for the next interview...

U day and Kahobadi,
where did you hear about the US military even considering people without green cards recruiting into the American Armed Forces???? If you heard or read that some where, it is a complete lie. They surely have been flexible on age for joining the US Army and the Marine Corp but they certainly require at least green card to recruit people. The minimum educational requirement is still a high school diploma or the GED.

Fluency in English is not a problem coz she went to a reputed school in India, n yes she is good at convincing people but still it dint help, the counselor dint ask a word bout anything else except me n my details. n said sorry, he dint even give her the reason for denying. Her majors is social work n there r no grad schools for that major in Nepal.
Anyways thank u guys for ur time.

they do recruit illegal aliens in american armed forces. don't you even know that there are thousands of illegal aliens being deployed by america in iraq as its armed force. when they come back they are granted citizenship. anyone can go for us army these days.
