When I went to Nepal for H1 visa stamping my I-40 was already approved. It should not be a problem. You have a choice of immigrating into the US. All they asked me that which company am I working for, what do you do there and what technology are you using. Three simple questions and all one sentence answers and visa was approved.

Max101's post should be the complete guide for anyone who is going to Nepal for H1 stamping. Wow.. he has covered everything! Thanks Max101.

Shram Karyalaya's process also went ok (not bad) for me. There is a one storey old house right across the street from Shram Karyalaya. There you can find people who will prepare the documents for you. I spent NRs 1000 for the whole "Foreign Employment Authorization" sticker. 250 for insurance, 250 for health certificate and 500 government fee. They prepare those document s right infront of you in 10 minutes and you just have to go to Shram Karyalaya and submit it. It took me about 4 hours to get the actual sticker.

I know this thread originated a long time ago and I wanted to clarify one thing. The whole thing about Shram Karyalaya is a hoax. I never had to go through such thing when I went to nepal a couple of months ago. It might be for people who are going for labor job in the Middle east or elsewhere so they have appropriate insurance and documentation.

My friend got H1B from Osaka.
He said the got namaste from the visa officer as greetings before he said good morning. Then the officer asked how long do you want to stay in the US? Is that salary OK for your family? Is that salary higher than you have in Japan. Living cost in US would be less than in Japan, so I hope you will enjoy living in the US. Goodluck with your research. Your passport will be posted to the address you have mentioned. Good day!

My appointment is on next monday. Will tell you about my inteview. Seems like visa processes in the US consulate in Osaka is fair and smooth. What we need is just our passport, photograph, 100$, H1B approval letter, letter of offer and alien registration card issued by Japan government.

Goodluck guys!

Hi fountaindew,

Foreign employment authorization is absolutely required while flying back to US with H1 visa. I know three of my friends not allowed to take the flight from Kathmandu for not having the authorization sticker in their passport. I also know one of my friend who was not asked for the authorization.. but I think it was the immigration officer's mistake. Unless you are bribe immigration officers (this is what I heard) they will not let you take the flight without it. They even ask for the receipt of Shram Karyalaya showing that you have paid the government tax of Rs 500.

Whether it is labor job in the middle east or an engineer's job in the US, they are both considered foreign employment by the Nepalese government.. it is kind of commonsense. BTW if you have green card this is not required.. only for H1 visa holders.

Does anyone know if Bad grades (<3.00 GPA) affect chances of getting H1 Visa stamp eventhough you have good enough job and make good enough money?

Can anyone tell me, how I-797 looks like? Is it a small piece attached to the new I-94, or is it the whole paper?

Thanks.

Thanks for all the info. Regarding the I - 797, do you need the original document or will a copy do??

I cannot remember if I was given an original but I sure do have a copy of it. But, I do have the orginal part of the bottom (the I-94).

to Birkhe2006,
They would deny H1 in the case of extension or New H1, if that job is other than needed skilled employee category (Programmer, Nursing) and you try to extend H1 for Psychology, Sociology related field, which are no longer needed in US would deny.
